As reported by The Guardian

Britain is weighing the use of armed forces to seize tankers belonging to Russia’s shadow fleet if they violate maritime law.

According to defense sources, such scenarios were discussed with NATO partners to ensure control over waters where ships may operate in contravention of international law.

In a joint statement endorsed by NATO members with access to the Baltic and North Seas, it calls for strict adherence to international law for all vessels moving in these waters.

Analysis of compliance, violations, and recent legal cases in salvage operations

 

The International Convention on Salvage represents one of the most significant developments in maritime law, establishing comprehensive legal frameworks for rescue operations at sea. This convention fundamentally transformed how salvage operations are conducted, compensated, and regulated across international waters, providing clarity and protection for both salvors and vessel owners during maritime emergencies.

Adopted by the International Maritime Organization in London on April 28, 1989, this convention replaced outdated legal structures that had governed maritime rescue operations for nearly eight decades. The new framework addresses modern challenges including environmental protection, technological advances in rescue operations, and the need for adequate incentives to encourage professional salvage services in increasingly dangerous marine environments.

Recreational boaters regularly stray into marine restricted areas, for which the penalties can be harsh. New high protection areas in the Gulf will complicate matters.

I have received the occasional call over the years from vessel operators who have unwittingly fished in Marine Protected Areas (MPAs) or the Cable Protection Zones (CPZ) in the Hauraki Gulf or Cook Strait and have been charged under the Marine Reserves Act 1971, or the Submarine Cables and Pipelines Protection Act 1996. Each of these acts prohibits fishing (either recreational or commercial) in these zones, and they carry heavy penalties, including the forfeiture

The American Boat & Yacht Council yesterday announced that its annual Marine Law Symposium is scheduled for April 1-2 at ABYC’s Annapolis, Md., headquarters. It also will stream online.

The continuing education event is designed for marine surveyors, attorneys, insurance professionals, boatbuilders, accessory manufacturers, compliance specialists and service leaders.

“The ABYC Marine Law Symposium sits at the intersection of marine safety standards, maritime law and marine surveying,” presenter James Coté of Coté Marine said in a statement. “It offers valuable networking and practical learning for marine professionals.”
